REGÍMENES ESPECIALES DE TRABAJADORES EXTRANJEROS EN ESPAÑA: AUTORIZACIONES DE RESIDENCIA Y TRABAJO

Abstract

[ES] El régimen jurídico-legal que regula la normativa en materia de extranjería es relativamente joven ya que tiene su origen en el año 1985 y a partir de ese momento han surgido nuevas leyes y reformas que han dado lugar a la actual Ley de Extranjería. El principal objetivo de esta norma es garantizar los derechos y libertades de las personas extranjeras que llegan al territorio español sea cual sea su motivo. Todo ello, llegando a una plena cohesión e integración social de la persona extranjera en la sociedad española. Las personas extranjeras procedentes de terceros países tienen reconocidos derechos fundamentales y si cumplen las normas establecidas, tendrán el mismo trato que los españoles. Estos derechos están relacionados principalmente con la Declaración de los Derechos Humanos y la Constitución Española. Existen colectivos que requieren un régimen jurídico especial ya que reúnen ciertas características que les hacen más vulnerables que otros extranjeros.

[EN] The legal regime governing the legislation on aliens is relatively young since its origins in 1985 and thereafter have emerged new laws and reforms that have given rise to the current Aliens Act. The main objective of this standard is to ensure the rights and freedoms of foreign persons who reach the Spanish territory whatever their reason. All this is coming to a full cohesion and social integration of the foreign person in Spanish society. Foreign persons from third countries have recognized fundamental rights and if they comply with the rules laid down, will have the same treatment as the Spaniards. These rights are primarily related to the Declaration of human rights and the Spanish Constitution. There are groups that require a special legal regime that meet certain characteristics that make them more vulnerable than other foreigners.
