Abstract

[ES] En este dictamen, se van a resolver una serie de cuestiones jurídicas planteadas por los familiares de D. Antonio, tras el estudio de la documentación aportada, jurisprudencia y doctrina aplicable, concluyéndose que concurre un delito de asesinato en grado de tentativa, que se tramitaría por el procedimiento sumario cuyo enjuiciamiento y fallo se atribuye a la Audiencia Provincial, que existe una circunstancia modificativa de Responsabilidad Criminal por la existencia de una esquizofrenia paranoide que lo declararía exento de Responsabilidad por el art. 20.1 del CP, con el consiguiente internamiento en Centro Psiquiátrico Penitenciario, prohibición de aproximarse a D. Manuel, esposa e hijos así como residir en el lugar donde viva la víctima con su familia, costas y responsabilidad civil por 162.438,8 euros.
