Abstract

[ES] En este dictamen, se van a resolver una serie de cuestiones jurídicas planteadas por los familiares de D. Antonio, tras el estudio de la documentación aportada, jurisprudencia y doctrina aplicable, concluyéndose que concurre un delito de asesinato en grado de tentativa, que se tramitaría por el procedimiento sumario cuyo enjuiciamiento y fallo se atribuye a la Audiencia Provincial, que existe una circunstancia modificativa de Responsabilidad Criminal por la existencia de una esquizofrenia paranoide que lo declararía exento de Responsabilidad por el art. 20.1 del CP, con el consiguiente internamiento en Centro Psiquiátrico Penitenciario, prohibición de aproximarse a D. Manuel, esposa e hijos así como residir en el lugar donde viva la víctima con su familia, costas y responsabilidad civil por 162.438,8 euros.[EN] In this opinion, they are going to solve a series of legal questions raised by the relatives of Antonio after studying the documentation, jurisprudence and doctrine applicable, concluding that attends a crime of attempted murder, it would be treated by the summary judgment procedure whose prosecution and is attributed to the Provincial Court, that there is a modifying circumstance of criminal responsibility by the existence of paranoid schizophrenia he declared exempt from liability by art. 20.1 CP, With consequent placement in Psychiatric Prison , prohibition of approaching D.
