Resumen
[ES] “La libertad de expresión viene recogida en el art.20 de la Constitución
Española, dicha libertad ocupa una posición preferente, como
elemento esencial para la formación de una opinión pública libre, y
que en tal condición es objeto de especial protección constitucional y
tiene reconocido por ese motivo un amplio espacio exento de
coacción, que solo excluye aquellas expresiones que sean intrínsecas y
absolutamente vejatorias que resulten innecesarias para la exposición
de la idea que se pretende expresar. La libertad de expresión no es un
derecho fundamental ilimitado, de manera que cualquier expresión no
merece, por el simple hecho de serlo, protección constitucional, toda
vez que el art.20.1 de la CE no reconoce un pretendido derecho al
insulto. Por su parte la jurisprudencia del TEDH ha afirmado que la
tolerancia y el respeto de la igual dignidad de todos los seres humanos
constituyen el fundamento de una sociedad democrática y pluralista”. 1

Freedom of expression is not, in itself, an unlimited fundamental right, so any expression does not deserve, for the simple fact of it, constitutional protection, since article 20.1 of the Spanish Constitution does not recognise a pretended right to insult.
