Resumen
Este trabajo expone las consecuencias jurídicas que pueden
derivarse de la aplicación del derecho mercantil español en lugar
de la CISG, o al revés, y cómo puede repercutir en la resolución de
posibles complicaciones relacionadas con el contrato mercantil.
Además, también contiene menciones a la normativa general
europea que regula la materia, así como los múltiples derechos de
los consumidores aplicables al caso según cada normativa y cómo
puede afectar a las distintas partes de la relación contractual.
En consecuencia, esta obra puede ser de gran interés para las
empresas radicadas en España que comercian frecuentemente con
empresas internacionales, para poder determinar adecuadamente
qué normativa puede ser más beneficiosa, o para los
emprendedores que quieran iniciar un negocio en el ámbito
internacional.
This paper exposes the legal consequences that may derive from the application of spanish commercial law instead of the CISG, or the other way around, and how it can impact on the resolution of possible complications related to the trade contract. Besides, it also contains mentions to the general European rules regulating the matter, as well as the many consumers rights applicable to the case according to each regulation and how that may affect to the different parts of the contractual relation. As a consequence, this work can be of high interest for businesses set on Spain that frequently trade with international companies in order to be able to properly determinate which regulation might be more beneficial, or for entrepreneurs who would like to start a business on the international sphere.
