Responsabilidad Patrimonial en materia sanitaria

Abstract

[ES]EL trabajo que nos ocupa, va a tratar de La responsabilidad patrimonial en las Administraciones Publicas en general, y un análisis detallado junto con este de la Responsabilidad Patrimonial en materia sanitaria.

Se plasma de esta manera, pues la responsabilidad patrimonial se estudia a nivel general, es decir a nivel de Administración Publica, estudiando todo el contenido de modo genérico, para así entender y poder dar más énfasis a todos los supuestos relacionados en materia sanitaria.

El punto de partida es una breve introducción de la responsabilidad patrimonial en , España y el origen y evolución histórica del concepto de responsabilidad , así como un repaso a la regulación actual de la misma.

Se da especial relevancia a la teoría general, en cuanto a quien es el titular de derecho a la indemnización , tipos de responsabilidad patrimonial y una explicación detallada de los presupuestos o requisitos de responsabilidad.

El punto final, analiza el procedimiento para ejercitar la responsabilidad patrimonial en todos sus ámbitos, y una conclusión basada en los supuestos analizados sobre responsabilidad patrimonial.

[EN]The work that occupies us, is going to treat of the hereditary responsability of the public administrations in general. and an analysis detailed together with this one of the hereditary responsability in sanitary matter. It takes shape this way, so the heriditary responsibility is studied at general level, that is to say at level of Public Administration, studying the whole content of a generic way, this way to understand and to be able to give more emphasis to all the assumptions related in sanitary matter.

The starting point is a brief introduction of the hereditary responsability in Spain and_ historical evolution of the concept of responsability, as well as a revision to the current regulation of the same one. Special relevancy happens to the general theory, as for whom he is the holder of right to the indemnification, types of hereditary responsability and a detailed explanation of budgets or requisites of responsability. The final point, he analyzes the procedure to exercise the hereditary responsability in all his ambiences, and a conclusion base in the assumptions analyzed on hereditary responsability.
