PERSONAS CON DISCAPACIDAD INTELECTUAL EN SITUACIÓN DE INTERNAMIENTO.

Abstract

Con el presente documento, nos centraremos en las personas con discapacidad intelectual y los factores que los vinculan al delito. De igual forma, se diferenciarán las medidas privativas y no privativas de libertad que se le ofrecen a este colectivo. Así como los recursos existentes en la sociedad para atender las necesidades de las personas con discapacidad que se encuentren en inmersas en un proceso delictivo. Inclusive, se marcarán las pautas a seguir en el protocolo de actuación frente a la problemática tanto dentro de los centros penitenciarios como de los centros de internamiento para menores infractores. De igual forma, se analizará todo lo mencionado anteriormente respecto a los menores infractores. En general, se tratará de obtener una visión objetiva sobre la situación en la que se encuentran las personas que sufren alguna discapacidad intelectual y están privadas de libertad tanto si son mayores de edad como si son menores.

With this essay, we will focus on people with intellectual disabilities and the factors that link them to crime. In the same way, the privative and non-custodial measures that are offered to this specific group will be differentiated, as well as the existing resources in society with the aim to meet the needs of people with disabilities who are immersed in a criminal process. Besides, we will indicate the guidelines to be followed in the protocol of action facing the problem both within the penitentiary centers and of the detention centers for juvenile offenders. In the same way, everything mentioned above will be analyzed with respect to the minor offenders. Overall, this bibliographical review will try to obtain an objective view of the current situation in which people who suffer from intelectual disabilities are deprived of their liberty, whether they are of legal age or minors.
