Las obligaciones del empresario en materia de seguridad social

Abstract

[ES]El objetivo de este trabajo es realizar un análisis detallado de las obligaciones que tiene el empresario como sujeto encargado de formalizar la relación jurídica de Seguridad Social. Para ello se profundizara en la forma, plazos y medios para hacer efectivo el cumplimiento en cuanto a los actos de encuadramiento (inscripción de empresas, afiliación, y alta y baja de trabajadores) y el proceso de cotización como requisito indispensable para el acceso a las prestaciones. También se profundizara en la repercusión que puede conllevar el incumpliendo de dichas obligaciones y los efectos que puede tener para el empresario. Para ello se analizará la jurisprudencia existente para la valoración del alcance que puede tener dicha responsabilidad para el empresario y el prejuicio que estos pueden ocasionar a los trabajadores que pretendan acceder a una prestación de Seguridad Social.

[EN]The objective of this work is to perform a detailed analysis of the obligations that the employer has as the person in charge of formalizing the legal relationship of Social Security. In order to achieve this, the form, deadlines and means to enforce compliance with the activities of enrollment (registration of companies, affiliation, and discharge of workers) and the quotation process as an essential requirement for access to benefits. There will also be an in-depth analysis of the repercussions of non-compliance with these obligations and the effects they may have on the employer. This will analyze the existing jurisprudence for the assessment of the scope that can have such responsibility for the employer and the prejudice that these can cause to workers who claim access to a Social Security benefit
