LA EXPROPIACIÓN FORZOSA, ESPECIAL ATENCIÓN AL PROCEDIMIENTO “EXTRAORDINARIO” DE URGENCIA

Abstract

Se alteran las fases respecto al método común, conque es significante el beneficio que ocasiona dicho cambio para el sujeto que ejecuta la expropiación. La ocupación del bien se efectúa antes que la fase del justiprecio, donde en esta última reside la esperanza de la equidad ante insuficiencias compensatorias; en la medida que debe de existir por parte de la persona expropiante una precisa motivación, ya sea por utilidad pública o interés social. El concepto de urgencia queda dañado por el aprovechamiento que se lleva a cabo, puesto que en muchas ocasiones no es real esta naturaleza y de tal modo, el procedimiento ordinario queda prácticamente inaplicable; pues el carácter excepcional se convierte en algo tristemente cotidiano. El pago oportuno de esta ocupación se desarrolla en un periodo indefinido y muy posterior a la invasión del bien, ya que la Administración no tiene prisa en su desembolso. The occupation of the property takes place before the fair price stage, where in the latter lies the hope of equity in the face of compensatory inadequacies; to the extent that it must exist on the part of the expropriation person a precise motivation, either for public use or in the social interest. The concept of urgency is damaged by the exploitation that is carried out, since in many cases this nature is not real and thus the ordinary procedure is practically inapplicable; for exceptional character becomes something sadly everyday. The timely payment of this occupation takes place in an indefinite period and well after the invasion of the property, since the Administration is not in a hurry in its disbursement.
