LA TUTELA DE LOS DERECHOS DE AUTOR EN INTERNET

Abstract

[ES] mediante los sistemas digitales, ha permitido que miles de autores creen obras protegibles por medio de los derechos de Propiedad Intelectual para luego compartirlas a través de plataformas como lo son las redes sociales. Pero, la cuestión que cabe plantear desde la perspectiva jurídica es qué normativa rige estas plataformas. Y, en un mismo sentido, qué sistema implantan estas empresas para defender los intereses de los usuarios que son autores de las obras protegibles. Cuestiones que serán abordadas en el presente trabajo, junto al interrogante sobre si son los sistemas normativos actuales correctos para defender los derechos de Propiedad Intelectual en un entorno como la red Internet. Para discernir acerca de estos planteamientos, en este estudio proponemos analizar las obras creadas en los medios digitales, que nacen con la irrevocable necesidad de ser compartidas y difundidas, hechas específicamente para los medios electrónicos (en particular, para Internet) y las condiciones a las que son sometidas en los términos y condiciones de las plataformas para las que son creadas, y en las que se difunden.

[EN] systems, has allowed thousands of authors to create copyright protected works and then share them on platforms as Social Media’s ones. But the question that need to be asked from a legal perspective is which laws apply these platforms. And, in the same way, which system do these companies implement to protect the rights of those users considered as “authors” of protected works. These question will be answered in this thesis, together with the most important we want to answer is if the current legal system, both internal and conventional sides, is the right one to protect copyright on the Internet. To answer this questions, our purpose is to study works created in digital media, born with the irrevocable need to be shared and disseminated, created specifically for the digital media (especially Internet) and subjected to the conditions established by the terms and conditions agreements of the platforms for which they are created, and in which they are shared.
