Responsabilidad civil en los diferentes sectores de actividad

Abstract

[ES] Observando las sentencias dictadas por los Tribunales de nuestro país, en los últimos años encontramos un gran aumento del número de sentencias que versan sobre demandas interpuestas a los abogados, procuradores o graduados sociales por parte de aquellas personas que contrataron sus servicios. Los fallos de las sentencias son muy divergentes, siendo el elemento fundamental para estudiar, tanto éstas como la doctrina que en que sustenta, en qué consistió la culpa del profesional, es decir, el error o negligencia que cometió. Este trabajo habla de la relación abogado-cliente, del tipo de daño que se puede producir, de la necesaria existencia de un nexo causal, y especialmente del tipo de responsabilidad, así como los motivos por los que se puede reclamar esa responsabilidad.[EN] When we notice the sentences issued by Courts to our country, in recent year we find a big increasementin the sentences which deal with complains filled against layers, solicitors and labour layers. The plaints are lodged by those people who hired their services. The results of judgments are very different, being the results the elements of study as well as the doctrine. An other thing that we must study is what the guilt consists in, that is to say the error or negligence. This project recompile the relation between the lawyer and client, the type of damage that it can produce, the necessary existence of a causal link, and specially the type of responsibility, and the reasons for demand this responsibility.
