PROCESO ESPECIAL DE DIVISIÓN DE LA HERENCIA

Abstract

[ES]En este trabajo de fin de grado se va a estudiar el procedimiento que ha de seguirse para realizarse la división judicial de la herencia, tanto en caso de que haya testamento como en el caso de las sucesiones intestadas. Así como cada una de las fases que se han de recorrer para que se produzca la partición de la herencia. Se analizarán también las reformas que se han operado en esta materia de sucesiones en los últimos años en las leyes en las que se encuentra regulada, tales como la Ley de Enjuiciamiento Civil y el Código Civil. Además, se analizaran los sujetos que podrán formar parte de este procedimiento y las acciones que podrán ejercer para hacer valer sus derechos dentro de la división de la herencia, tanto si son coherederos o legatarios de parte alícuota, como si son acreedores de la misma.

[EN]The procedure to be followed for the judicial division of the inheritance will be studied in this final project, both in the case of a will and in the case of intestate successions. As well as each of the phases through which it must be passed so that the partition of the inheritance occurs. It will also be analyzed the reforms that have been carried out in this matter of successions in recent years in the laws in which it is regulated, such as the Law of Civil Procedure and the Civil Code. In addition, it will be analyzed the parties that may be part of this procedure and the actions that may be exercised to assert their rights within the division of the inheritance, whether they are joint heirs or legatees of an aliquot, or if they are creditors of the same.
