La relación laboral del trabajador extranjero en España

Abstract

[ES]La Ley de Extranjería exige que para poder residir y trabajar legalmente en España, el extranjero debe de solicitar y obtener previamente una autorización. Dentro de los diferentes tipos de autorizaciones, se encuentra la lucrativa, más conocida como autorización temporal de residencia y trabajo. Sobre la misma, se encuentra la correspondiente al trabajo por cuenta propia y por cuenta ajena. El objetivo principal es analizar y conocer los contenidos expuestos legal y reglamentariamente, observando los requisitos y las pautas que se exigen en todo momento. ¿Es necesario que todos los extranjeros obtengan una autorización?, ¿Conlleva esto la existencia de desigualdades entre extranjeros y nacionales?, ¿Están correctamente fijados los procedimientos de regulación para la concesión?

[EN]The Aliens Law requires that in order to be able to reside and work legally in Spain, the foreigner must request and obtain prior authorization. Among the different types of authorizations, there is the lucrative one, better known as the temporary residence and work authorization. On the same, it is the one corresponding to the work for own account and for other people's account. The main objective is to analyze and know the legal and statutory contents, observing the requirements and the guidelines that are demanded at all times. Is it necessary for all foreigners to obtain an authorization? Does the existence of inequalities exist between foreigners and nationals? Are the regulatory procedures for the concession correctly established?
