TRASCENDENCIA PROCESAL DEL FRACASO DEL MATRIMONIO EN EL PROCEDIMIENTO MATRIMONIAL CANÓNICO

Abstract

A través de este trabajo de fin de grado, he podido estudiar en que consiste el fracaso matrimonial en el ámbito del derecho canónico, así como llevar a cabo su procedimiento, las consecuencias que conlleva y la forma que tiene la comunidad eclesiástica de entender el matrimonio y su fracaso. Así como el estudio de las aportaciones del Papa Francisco, en referencia a la reforma del proceso guiándonos hacia la búsqueda de la verdad en cuando al consentimiento inicial que fue dado por los cónyuges y sin olvidar que se trata de procesos difíciles, meticulosos que requieren una gran formación de los tribunales y tacto ya que entran en juego muchos sentimientos y estados emocionales de las personas.

Through this final degree project, I have been able to study what marriage failure consists of in the field of canon law, as well as carry out its procedure, the consequences that it entails and the way that the ecclesiastical community has to understand marriage. and its failure. As well as the study of the contributions of Papa Francisco, in reference to the reform of the process guiding us towards the search for truth regarding the initial consent that was given by the spouses and without forgetting that these are difficult, meticulous processes that require a great training of the courts and tact since many feelings and emotional states of people come into play.
