Mediación penal en adultos

Abstract

[ES] Es un análisis de la mediación penal en adultos, este proceso es una práctica de la Justicia restaurativa, con lo cual es necesario generar una base teórica para contextualizar este nuevo método. Para ello hablaremos de las dos vías judiciales existentes, la Justicia Retribucionista, que corresponde con la vía jurídica clásica y la Justicia Restaurativa, que nace como una vía alternativa de resolución de conflictos. El acto de mediar tiene diferentes ámbitos de intervención, sin embargo este método tiene unas características, principios y ventajas comunes e independientes, sin tener en cuenta el campo de actuación, ya sea familiar, mercantil o civil, por ejemplo. Esta es la raíz del proceso así que es imprescindible su explicación para posteriormente centrarnos en el ámbito penal de adultos y sus peculiaridades específicas. Finalmente se llevará a cabo una revisión del o la profesional en Trabajo social como figura mediadora en este procedimiento de medición y las posteriores conclusiones obtenidas del estudio sobre el tema de mediación penal en adultos.

[EN] Is an analysis of the penal mediation in relation with adults, this process is a practice that belongs to the restorative Justice, what implies that it is necessary to create a theoretical background to contextualize this new method. In order to do that, two different judicial procedures will be presented, the Reward Justice, that corresponds to the classic legal procedure and the Restorative Justice, which arose as an alternative to solve conflicts. The action of interceding has different fields of intervention, however this method has some features, principles and advantages that are common and independent, without taking into account the field of action, which could be familiar, commercial or civil, for instance. This is the origin of this process so that it is essential its explanation to subsequently get focused on the adults’ penal field and its specific peculiarities. As a final aspect of this work, an overview of the Social worker as an intermediary figure within this mediation procedure will be carried out and the subsequent conclusions obtained from the study on the topic of adults’ penal mediation will be regarded.
