LA INFLUENCIA DE CESARE BECCARIA EN LA PRIMERA CODIFICACIÓN PENAL EUROPEA: LOS CÓDIGOS PENALES DE AUSTRIA DE 1803, FRANCIA DE 1810 Y ESPAÑA DE 1822.

Abstract

[ES] Se expone el análisis del derecho penal del Antiguo Régimen con ejemplos significativos como los casos de Jean Calas y Robert Damiens cuyo objeto es ilustrar el pensamiento de los predecesores a la obra de Beccaria: Montesquieu y Voltaire. A continuación se realiza un estudio detallado del Tratado de Beccaria, centrándose en aspectos como la vida del autor, su influencia en la Escuela Clásica Penal y se expone el ideario recogido en la misma para compararlo posteriormente y hacer ver cómo influye en la Codificación Penal de principios del siglo XIX, destacando los Códigos Penales de Austria, Francia y España. Finalmente se analiza la importancia del sistema penitenciario a raíz del pensamiento de Beccaria, y se realiza un estudio breve del utilitarismo de Bentham.

[EN] An analysis on the Ancient Régime's criminal law is displayed, with some notable examples, as are the cases of Jean Calas and Robert Damiens. Its main purpose is to illustrate the thoughts and ideas from the predecessors of Beccaria's work: Montesquieu and Voltaire. Below comes a detailed study on Beccaria's treatise, focusing on various aspects, as are the author's life and his influence in the Classical School of criminology. This aformentioned study expounds upon the ideology compendium registered in it, in order to compare that compendium and show how it influences the Criminal Codification from the beginning of the nineteenth century, highlighting the Criminal Codes of Austria, France and Spain. The prison's system importance is analyzed finally as Beccaria's thinking resulting approach. Bentham's utilitarianism is briefly reviewed too.
