DELITO DE AGRESIÓN Y ABUSO SEXUAL

Abstract

[ES] La diferencia entre agresión y abuso sexual es fundamentalmente la presencia de violencia o intimidación. En el delito de agresión sexual una persona trata de acceder al cuerpo de otra con fines sexuales sin su consentimiento y empleando violencia o intimidación para conseguirlo. Y, el delito de abuso sexual se realiza cuando una persona accede al cuerpo de otra sin consentimiento y sin violencia física. Para poder perseguir estos delitos será necesaria la denuncia de persona agraviada, de su representante legal o querella del Ministerio Fiscal.

[EN] The difference between crime of sexual aggression and sexual abuse is primarily the presence of violence or intimidation. In the crime of sexual aggression one person tries to access the body of another for sexual purposes without his consent and employing violence or intimidation to get it. And, the crime of sexual abuse is donde when one person accesses the body of another without consent and without physical violence. In order to prosecute these crimes it will be necessary the complaint of aggrieved person, of his legal representative or complaint of the Fiscal Ministry.
