RECONOCIMIENTO DE LA FILIACIÓN RESULTANTE DE LOS CONTRATOS DE MATERNIDAD SUBROGADA REALIZADOS EN EL EXTRANJERO.

Abstract

El presente trabajo analiza la situación actual de la gestación subrogada en España y la evolución jurisprudencial y doctrinal relacionado con esta materia. Se analizan cómo se puede validar la filiación de la gestión subrogada que se contrae mediante contrato en otro país, estudiando algunas de las diferentes problemáticas que a lo largo del tiempo han ido surgiendo en diferentes países. También se hará un análisis en torno a la jurisprudencia de nuestro país, los cambios que la DGRN ha ido introduciendo en nuestro entorno jurídico, y la posición que el Tribunal Europeo de Derechos Humanos (en adelante TEDH) ha adoptado en situaciones complejas que se han venido aconteciendo en el tiempo. The present work analyzes the current situation of the surrogacy in Spain and the jurisprudential and doctrinal evolution related to this matter. They analyze how the affiliation of the surrogate management that is contracted through a contract in another country can be validated, studying some of the different problems that have arisen in different countries over time. There will also be an analysis around the jurisprudence of our country, the changes that the DGRN has been introducing in our legal environment, and the position that the European Court of Human Rights (hereinafter TEDH) has adopted in complex situations that have been been happening in time.
