La mediación familiar como marco de intervención del trabajo social

Abstract

[ES]La memoria que se presenta analiza el fenómeno del auge que la Mediación Familiar está teniendo en los últimos años como sistema alternativo al judicial para la resolución de conflictos, más concretamente en el caso de la Comunidad Autónoma andaluza. La experiencia exitosa y el interés creciente por la mediación familiar han supuesto la necesidad en los últimos años de regular normativamente esta actividad y la configuración a nivel legal de la figura del mediador familiar, en una primera instancia por iniciativa legal de las Comunidades Autónomas y con posterioridad por el Estado, situación no exenta de contradicciones. El estudio centra sus conclusiones en la Comunidad Autónoma de Andalucía partiendo de la existencia de la normativa necesaria que regula la actividad mediante el Registro de Mediadores Familiares activo desde hace aproximadamente un año. Igualmente se contempla la incidencia generada al haber incorporado en la normativa modificaciones impuestas por el reciente desarrollo del Registro de Mediación Civil y Mercantil del Estado. Se presta especial atención a la incidencia de esta nueva situación normativa en la Mediación Familiar, como uno de los marcos de intervención del Trabajo Social. Para este análisis se ha recurrido a dos fuentes primarias de datos: los datos aportados por el Registro de Mediadores Familiares de Andalucía hasta el 30 de abril de 2014 y el marco normativo que regula y delimita la mediación hasta el momento de cierre de esta memoria. [EN]The research that I am presenting analyzes the increasing phenomenon that family mediation is having in the last few years as an alternative system to the judicial one for the resolution of conflicts, specifically within the Autonomous Community of Andalusia. The successful results and the growing interest in family meditation have lately resulted in the need for regulating, from a legal perspective, this activity and the role of the family mediator. This regulation was initiated by the Regional Governments and followed by the State; therefore, creating a situation with many contradictions. The study draws its conclusions from the Autonomous Community of Andalusia, going from the supply of the necessary regulations that rules the activity of the Registry of Family Mediators which has been operating for approximately a year. Likewise, the recent creation of the Registry for Business and Civil Mediation of the State has generated an impact in the current Andalusian regulations. Special attention is given to the impact of this new regulation in family mediation; as a framework for social work intervention. For this analysis we have used two primary data sources: the data provided by the Family Mediator Registry of Andalusia up to April 30th, 2014; and also the data of the regulations framework.
