ACERCA DE LA NECESIDAD DEL DERECHO PENAL EN MATERIA URBANÍSTICA FRACASO EN EL DERECHO ADMINISTRATIVO

Abstract

[ES] La presente investigación tiene como finalidad principal identificar y entender los puntos débiles del Derecho administrativo en cuanto a control de la legalidad urbanística y, en consecuencia, la aparición del Derecho penal para combatir la indisciplina urbanística. Para ello, se estudia y se diferencia previamente entre los términos urbanismo y ordenación del territorio, y se delimita el marco jurídico competencial de este último. Posteriormente, se da con un concepto de corrupción urbanística que resume de qué trata este tipo de corrupción y se analizan las posibles causas que la fomentan. Además, por otra parte, se estudia la figura del funcionario público como sujeto activo de la delincuencia urbanística. Finalmente, se comprueba si se han alcanzado los objetivos inicialmente establecidos y se aportan una serie de posibles soluciones para acabar con el complejo problema, extendido por toda la geografía española, de la corrupción urbanística.

[EN] The present research has as main purpose identify and understand the weaknesses of administrative law regarding the control of urban legality and, in consecuense, the emergence of criminal law to combat urban indiscipline. For this reason, previously, I have studied the difference between the terms urban and regional planning, and I have delimited the competitional legal framework of this latter. Later, I have found a concept of urban corruption that sums up what means this kind of corruption and their possible causes. Moreover, on the other hand, the figure of the civil servant has been studied as an active subject of urban crime. Finally, It has checked whether I have achieved the initially established objectives and I have explained a number of possible solutions to end this complex problem spread throughout the Spanish geography known as urban corruption.
