Resumen
[ES] El objeto de este trabajo es realizar un análisis profundo de la estructura típica del delito de robo con fuerza en las cosas, teniendo como base las abundantes opiniones doctrinales y jurisprudencia que existe sobre este tema. Así, en este trabajo se analiza el bien jurídico protegido de este delito, el sujeto activo y pasivo, el objeto material, la conducta típica con sus distintas modalidades, los tipos agravados y cualificados, los elementos subjetivos del tipo y la consumación de este delito. Asimismo, a lo largo de la exposición se analizan casos específicos en los que existen dudas sobre si la conducta puede ser calificada como un robo con fuerza en las cosas.
[EN] The purpose of this work is to carry out an in-depth analysis of the typical structure of the crime of theft with force in things, based on the abundant doctrinal opinions and jurisprudence that exists on this subject. Thus, this paper analyzes the protected legal asset of this crime, the active and passive subject, the material object, the typical behavior with its different modalities, the aggravated and qualified types, the subjective elements of the type and the consummation of this crime . Also, throughout the exhibition, specific cases are analyzed in which there are doubts about whether the behavior can be classified as a theft with force in things.
