LA HUELGA LABORAL EN ESPAÑA

Abstract

[ES] El objetivo del presente trabajo de fin de grado es realizar un análisis sobre la configuración legal y régimen jurídico del derecho de huelga en España. Esta investigación se centra, en un primer momento, en el estudio del concepto de huelga laboral desde distintos puntos de vista, quiénes son titulares de este derecho, procedimientos, consecuencias y formas de evitarla, junto el análisis de los datos sobre el número de huelgas realizadas en los últimos años desde 2008 hasta nuestros días. Todo ello se concluye con una pequeña reflexión sobre las líneas de desarrollo futuro de este derecho, y cuáles serían los motivos por los que no existe una ley específica para su regulación. La principal motivación de la elección de este tema es debida a la importancia que, desde mi punto de vista, tiene actualmente este derecho fundamental y el desconocimiento del mismo, que nos podría llevar a actuar de forma ilegal por el hecho de no saber cuál es el alcance y contenido del mismo.

[EN] The aim of the present work end of degree, is to realize an analysis about the legal configuration and juridical regime of the right to strike in Spain. The investigation centres on, at the first moment in the study of the concept about labor strike from different point of view, who are holders of this right, procedures, consequences and ways of avoiding it, and the analysis of the information about the number of strikes realized in the last year since 2008. All this concludes with a small reflection about the future lines development of this right, and which would be the reasons for which a specific law does not exist for it regulation. The principal motivation for the choice of this topic performs due to the importance which, from my point of view, it has nowadays this fundamental right and the ignorance of the same one, which might lead us to act illegally for the fact of not to know which is the scope and content of the same one.
