Resumen
[ES] El ser humano ha vivido del capital de la naturaleza y no de sus
ingresos. El objetivo es cambiar
la tendencia y promover la racionalización del uso de recursos
naturales para su propia
protección y por ende, la de la salud y calidad de vida de las
personas.
Para ello nace el derecho ambiental que es recogido en el artículo
cuarenta y cinco de la
constitución española y en la Ley 26/2007 de 23 de octubre. Se
trata de un conjunto de normas
jurídicas que regulan las actividades humanas para proteger el
medioambiente o la naturaleza.
En este trabajo estudiaremos el concepto de daño ambiental, sus
tipos y los diferentes
tratamientos que se dan a la figura de daño ambiental. Asimismo,
vamos a tratar las garantías y
los seguros ambientales, la indemnización y reparación por daños
ambientales, comentando
algún caso de daños y citando algún ejemplo de jurisprudencia
civil.
[EN] Human being has made profit from environment instead of its incomes. The main aim is to change the tendency and promote rationalization of the use of natural resources for its own protection and consequently health and well-being. To fulfil this achievement environmental laws have been created, which can be found in the Spanish Constitution (article 45) and in Law 26/2007 from 23rd of October. They are an amount of laws which regulate human activities to protect environment and nature. In this document, concepts like environmental damage, types and different treatments will be studied. Therefore, guarantees and nature insurances, compensation, reversibility of environmental damages, describing different specific occurrences and quoting some civil jurisprudence.
