Consumación y formas imperfectas de ejecución: Hurto y robo

Abstract

[ES]Este trabajo de fin de grado trata sobre la consumación en los delitos de hurto y de robo y las formas imperfectas de ejecución del mismo. En cuanto a la Consumación, analizo el momento consumativo en el que tienen relevancia las siguientes teorias: "mera contrectatio o aprehensión" el delito se consuma cuando el sujeto toca la cosa, la "ablatio" no basta con cogerla, sino hay que sacarla de la esfera de control del dueño, la "locupletatio", tomo la cosa, la saco del control del dueño y ademas la uso y finalmente la "illactio" en este caso, se consuma cuando tengo una disponibilidad minima de la cosa. La teoria predominante de la doctrina es la teoria de la disponibilidad. Esta se basa en que se consuma el delito con la capacidad de disponer aunque sea fugaz y breve. En lo que importa a la tentativa, existen supuestos donde es difícil diferenciar la tentativa acabada de la consumacion en las diversas teorias, especialmente en los casos de fuga o de ocultacion.

[EN]This end of degree work is about the consummation in the offences of theft and robbery and imperfect forms of execution. As for the consummation, analyze the consumativo moment in which have relevance the following theories: "mere contrectatio or apprehension" crime is consummated when the subject is the thing, "ablatio" is not enough to catch it, but must be removed from the sphere of control of the owner, the "locupletatio", took the thing, extracted it of the control of the owner and also the use and finally the "illactio" in this case it when I have a minimum availability of the thing. The predominant theory of the doctrine is the theory of the availability. It is based on that used the crime with the ability to have even if it is brief and fleeting.What matters to the attempt, there are cases where it is difficult to differentiate the finished attempt the consummation in different theories, especially in cases of flight or concealment.
