LA PRISIÓN PROVISIONAL

Abstract

[ES] Este trabajo está enfocado a analizar la prisión provisional desde sus antecedentes hasta la regulación actual con la repercusión que han ido obteniendo las diferentes leyes en la delimitación de esta figura, sobre todo en la configuración de una medida cautelar que cada vez tiene un objetivo más eficaz: salvaguardar el derecho fundamental a la libertad reconocido en nuestra Constitución.

[EN] This project is focused on analyzing the pre-trial detention from its antecedent history to the present regulation along with the impact that the different laws have had on the delimitation of this figure, mainly in the setting of an interim measure that is becoming a more effective aim: safeguard the fundamental right to freedom recognized in the Constitution.
