Reconocimiento en España de figuras análogas a la adopción internacional

Abstract

La adopción, corno institución jurídica de protección de menores y salvaguarda del principio de interés superior del menor, ha de estudiarse en la actualidad desde una perspectiva internacional, en cuanto a su constitución, pero, principalmente en torno a sus efectos, para garantizar su perpetuidad y sobre todo su adecuación a la realidad social actual , teniendo presente que, en todos los ordenamientos jurídicos, no se regula de la misma manera.

En este trabajo, vamos a anal izar cómo se reconocen en España adopciones realizad as en el marco de una legislación extranjera y cómo despliegan las mismas sus efectos en nuestro país. De esta forma, se obtendrá una visión en conjunto sobre la materia y sobre su necesidad práctica

The adoption, as a legal institution to take care of children, protect them and to protect the principie of best interests of the chile\, should be studied nowadays from an international view. This point of view should be used to study its creation buy mainly its effects in order to assure its perpetuity. In the same way, it is important to assure that this institution is adequate to the social reality without forgetting that not in all legal systems the adoption is defined in the same way.

In this work we are going to study bow acloptions make in a foreign legal system are recognizecin Spain and the way the play their effects. In this way, a global vision about tbe subject and its practical need, would be acquired.
