Abstract

En este trabajo nos centramos en el régimen jurídico de la división de la comunidad de bienes en el Derecho romano. Diferenciaremos las principales características del consortium ercto non cito. Haremos referencia a la actiofamiliae erciscundae . Esta acción sufre una serie de modificaciones que hacen que aparezca la actio communi dividundo que no sólo se centra en la división de la cosa común, como ocurría en época clásica, sino que con la regulación ju stinianea, la actio communi dividundo tiene un fin más: regular las controversias entre los condóminos. Por último, analizaremos la influencia de la acción de división en el Código civil español.
