El mutuum y su evolución histórica en el Derecho romano y su pervivencia en el Código Civil español.

Abstract

[ES] El trabajo realizado versa sobre el mutuum, contrato de origen arcaico consistente en la entrega de un bien del mutuante al mutuario para que éste, pasado un tiempo se lo devuelva en la misma cantidad y calidad. Aunque parece que es un contrato gratuito, en realidad no lo es, sólo lo parece por un déficit del vocabulario romano, estando esto íntimamente ligado con la usura o usurae, término que ha sufrido una evolución en el significado y que hace que actualmente se entienda de manera diferente a la entendida en la época romana. Es tal la evolución que ha sufrido el mutuo que incluso ha variado la nomenclatura utilizada para referirse a él, utilizando hoy en día el término «simple préstamo».

[EN] The work done is about the mutuum, contract of archaic origin consisting of the delivery of a thing from the mutuante to the mutuario so that the borrower, after a time, will return it in the same quantity and quality. Although it seems that it is a free contract, in fact it is not, that only seems it for a deficit of the Roman vocabulary, being this closely linked with the usury or usurae, term that has undergone an evolution in the meaning and that makes today understood in a way different from the one understood in Roman times. Such is the evolution that has undergone the mutual that has even changed the nomenclature used to refer to it, using today the term «simple use loan».
