Resumen
Este trabajo de fin de grado trata sobre la problemática actual de la patente farmacéutica en el ámbito comunitario cincuenta años después de su primera regulación. En primer lugar se establece el concepto de patente, y las especialidades de las patentes farmacéuticas respecto del sistema general de patentes. Se introducen los antecedentes legales e históricos de la actual situación. Se analizan los principales problemas con los que se encuentra esta industria, como el certificado complementario de protección, el alarmante crecimiento de los medicamentos falsificados y el auge de los genéricos, con especial referencia al Sofosbuvir, medicamento de la Hepatitis C. Por otro lado se analiza la legislación y jurisprudenc ia comunitaria respecto de estos problemas mediante el sistema de precios de referencia de Ja Unión Europea y la transparencia de los precios, así como Ja intervención de las Administraciones Públicas en el precio de los medicamentos. Se proponen posibles vías para solucionar estos problemas.
This end of degree's dissertation talks about the current problems of the pharmaceutical patents right at EU leYe!, fifty years after of its first J egalisation. To start it establishes the concept of patent, and the different specialities m companson with the general system of patents as previous legal and historical records of the current scenario. There are analysed the main problems that this industry, such as the supplementary certificate of the pharmaceutical patents' 111 force protection , the dangerous increase of faked medicines and the boom of the generics, with special reference to the Sofosbuvir, medicine against the Hepatitis C. In the other side, i t's analysed the European Jegislation & jurisprudence of the above issues, regarding the EU system of prices reference and the price transparency , as well as the Public Administration role with the medicines' price and if it's taki ng too much part on it. There are proposed as well, possible ways to solve these issues.
