LA EVOLUCIÓN DEL DERECHO DEL MAR Y SU APLICACIÓN EN ESPAÑA

Abstract

En el presente trabajo se abordarán temas como la evolución del Derecho del Mar, el establecimiento y la delimitación de los espacios marinos, la descripción de cada uno de ellos y muchas otras cuestiones relativas al Derecho del Mar, tanto en el ámbito internacional como en el ámbito nacional, haciendo así una descripción de la influencia del Estado español en cada uno de los espacios marinos. En un pnmer bloque se estudiará los antecedentes históricos de gran relevancia, fruto de la regulación actual del Derecho del Mar, así como los distintos espacios marinos junto con la Convención de Naciones Unidas del Derecho del Mar, que es la base legislativa. En un segundo bloque se estudiará el órgano judicial establecido por la Convención de 1982, el Tribunal Internacional del Derecho del Mar, incluyendo el papel de España ante tal órgano. Por último, se estudiará la relación, delimitación y situación actual entre España y Gibraltar.

This work will address issues such as the evolution of the law of the sea, the establishment and the delimitation of marine spaces, the description of each of these and many other issues relating to the law of the sea, both internationally and nationally, thus making a description of the influence of the Spanish State in each of thc marine spaces. The historical background of great significance, the result of the current regulation of the law of thc sea, as well as the different marine areas together with the United Nations for the law of the Sea Convention, which is thc legislative basis will be studied on a first block. In a second block will be the judicial body established by the 1982 Convention, the Intemational Tribunal for the law of the sea, including the role of Spain to such authority. Finally, will study the relationship, delimitation and current situation between Spain and Gibraltar.
