Resumen
[ES] Con el presente Trabajo Fin de Máster desea realizarse un análisis pormenorizado de los criterios establecidos por la jurisprudencia europea y nacional para determinar el carácter abusivo de las cláusulas contenidas en los contratos de préstamo hipotecario celebrados entre empresarios o profesionales y consumidores o usuarios. El objetivo de este dictamen es dar a conocer cómo deben aplicarse los mismos en relación a dos cláusulas concretas como son las de vencimiento anticipado e intereses moratorios así cómo aplicar dichos criterios a la ejecución hipotecaria expuesta en el dictamen para determinar si han de ser declaradas o no abusivas.
[EN] With the present work end of Master want to perform a detailed analysis of the criteria established by European and national case law to determine the abusive character of the clauses contained in the mortgage loan contracts concluded among entrepreneurs, professionals and consumers or users. The aim of this opinion is to publicize how should be the same in relation to two specific clauses such as those of early maturity and default interest thus how applying these criteria to foreclosure in the opinion for to determine if they should be declared or not abusive.
