CONTEMPLACIÓN DE LOS DELITOS CONTRA MEDIO AMBIENTE COMO CRÍMENES CONTRA LA HUMANIDAD

Abstract

[ES]El fundamento de este trabajo consiste en la importancia de preservar y proteger el medio ambiente desde un punto de vista jurídico internacional, contemplando el medio ambiente como derecho humano y como delito en los ámbitos internacional, comunitario y estatal, así como su protección. Los Estados cada vez han sido más conscientes de la importancia de la conservación del medio ambiente y de la necesidad de su protección. Se ha realizado una labor esencial entre los Estados y las instituciones para lograr establecer unas pautas a seguir y entablar una concienciación de la problemática existente del medio ambiente. Sin menoscabar esta labor, en la actualidad ha quedado demostrado que a pesar de los intentos, las intenciones son insuficientes y existen numerosas lagunas en la materia. A partir de este precepto para solucionar estos problemas se plantea la vertiente de considerar los delitos del medio ambiente como crímenes contra la humanidad.

[EN]The election of this topic is caused by the importance of preserving the environment from a legal point of view from two aspects: On the one hand, a categorization of environment alike human rights or third generation right and on the other hand, the regulation of its protection related to international law, community, constitutional and penal. States are becoming more aware about the need of its protection, and they have done an important labour to achieve the establishment of steps to follow, and that of an individual and collective awareness of environmental protection. Without undervaluing this labour, nowadays it is obvious the attempts haven't proven sufficient. From this precept to solve these issues, it's settled up to consider environmental felonies as crimes against humanity.
