EL DERECHO DE HUELGA EN EL ORDENAMIENTO JURÍDICO: ESPECIAL MECIÓN A SU PROCEDIMIENTO.

Abstract

[ES] El objetivo del presente trabajo se basa en un paseo por las distintas fases que se llevan a cabo dentro del ejercicio de la huelga, desde un punto de vista jurídico, además de hacer mención a las sentencias más relevantes que se han producido en nuestro Ordenamiento Jurídico, las cuales han sido las que han ido marcando en cierta medida el camino de este derecho. Fijaremos los aspectos más importantes que realizan el Comité de Huelga y la importancia de los Servicios Esenciales, diferenciando entre los servicios de mantenimiento y de seguridad, las características que se dan en el sector público y sector privado. Teniendo en cuenta que este derecho en la actualidad se ha visto mermado por la crisis económica en la que estamos sumergidos, haremos alusión a las últimas novedades que se intentan implantar.

[EN] The main purpose of this work consists of a walk through the different phases implemented within the strike, from a legal perspective, as well as mentioning the most relevant judgments produced in our Legal System, which have been the ones, to some extent, to set the way forward. The most significant aspects carried out by the Strike Committee will be established, just like the importance of the Essential Services, differentiating between maintenance and security services, characteristics given in the public and private sector. By bearing in mind that, nowadays, this right has been depleted by the economic crisis in which we are submerged, we will introduce the latest developments that are trying to be implemented.
