DERECHO A LA CONCILIACIÓN DE LA VIDA FAMILIAR Y LABORAL COMO DERECHO INTRÍNSECO A LA IGUALDAD

Resumen
[ES] El derecho de conciliación de la vida familiar y laboral es un derecho intrínseco del derecho fundamental a la igualdad y no discriminación, reconocido en el artículo 14 de la Constitución Española.
En este trabajo se desarrolla la normativa tanto a nivel europeo, nacional, como algunos aspectos clave de los Estatutos de Autonomía, así como los límites, dificultades y la protección que el ordenamiento otorga a este derecho.
Pues bien, aun siendo un derecho que deriva de otro considerado como constitucional, y además, fundamental, no se considera el derecho de conciliación como un derecho constitucional, sino como un principio rector de las políticas sociales, por lo que sirve de interpretación para otros derechos.
La falta de una normativa tanto a nivel europeo como nacional que obligue a las empresas y administraciones públicas a permitir a los trabajadores y trabajadoras el ejercicio legítimo de su derecho de conciliación, así como la discrecional judicial a la hora de permitir el disfrute del mismo, es la mayor dificultad que se plantea, ya que de esta forma, los trabajadores y trabajadoras se encuentra en una situación de desamparo, al no tener en cuenta circunstancias personales y familiares concretas, quedando limitado su derecho a posibles situaciones que reflejan los convenios colectivos.
[EN] The right of reconciliation of work and family life is an intrinsic right of the fundamental right to equality and non-discrimination, recognized in the article 14 of the Spanish constitution. The present paper analyses the legal framework in Europe and Spain, such as key issues in many Statutes of Autonomy as well as the legal bounds, difficulties and protection that this right entitles. Even though it is considered a right derived from a constitutional one, and fundamental, the right of reconciliation of work is not considered as a constitutional right, but as the basic principle of the social politics, which may be interpreted for other rights. The lack of standards both at European and national levels that obliged companies and public administrations to allow workers the legitimate exercise of their right to conciliation, as well as the judicial discretion of the Court to allow the enjoyment of the same, is the biggest difficulty that arises in this way, workers is in a situation of abandonment , to not taking into account specific personal and family circumstances, and limiting their right to possible situations that reflect the collective agreements.
