DETENCIÓN Y PROCEDIMIENTO DE HABEAS CORPUS

Abstract

En la primera parte del trabajo nos centraremos en analizar el derecho a la libertad personal. El principal objetivo, es analizar qué se entiende por detención y cuáles son los derechos que les corresponden a las personas privadas de libertad a la luz de la Constitución y de la Ley de Enjuiciamiento Criminal En la segunda parte del trabajo, estudiaremos el Habeas corpus. Se ha consagrado como una institución jurídica con una enorme relevancia, desde sus orígenes en la Edad Media hasta nuestros días, constituyéndose como mecanismo esencial para garantizar la protección de la libertad e integridad física de las personas frente a las detenciones ilegales. Para ello analizaremos dicha institución mediante su regulación en la Ley Orgánica 6/1984, de 24 de mayo.

In the first part of the research I’m going to focus on analyzing the right to personal liberty. The main objective of this work is analyze what is meant by detention and what are the rights that correspond to persons deprived of liberty under the Spanish Constitution and the Criminal Procedure Law. In the second part of the work, I am going to study Habeas corpus. It has been established as a legal institution, with enormous relevance, since the startup in the medieval Ages to the present times. Establishing as an essential mechanism to guarantee protection of the liberty and physical integrity of people against illegal detentions. For that purpose, I am going to study this institution through its regulation in the Organic Law 6/1984, from the 24th of May.
