ACCIÓN REIVINDICATORIA --- ACCESIÓN

Abstract

[ES] El tema que se plantea en este dictamen jurídico del Trabajo Fin de Máster, es el conflicto existente entre dos partes en relación a la propiedad de un bien inmueble. Las partes basan sus posturas, por un lado, el actor, en ser propietario de una finca por la que ejerce una "acción reivindicatoria" de la propiedad por estar ante un caso de "accesión", es decir, considera que el solar sobre el que ha construido es del actor pero no lo construido sobre este, ya que construyo de buena fe pensando que ese solar era de su propiedad. Se concluye que operaría en este caso la accesión del artículo 361 del Código Civil al probarse tanto la buena fe de la defensa, como que lo construido es de nueva construcción.

[EN] The topic that raises in this juridical report of the Work End of Master's degree, is the existing dilemma between two parts as regards the property of a good building. The parts base its positions, on the one hand, the actor, in being an owner of a farm for which he exercises a "action reivindicatoria" of the property for being occupied on another part, and on the other hand, the defense, base its position in the right to possess for being before a case of "agreement", that is to say, he thinks that the lot on which he has constructed belongs to the actor but it constructed on this one, since I construct honestly thinking that this lot was of its property. One concludes that it would operate in this case, the agreement of the article 361 of the Civil Code because there has been proved so much the good faith of the defense like which the built thing is of new construction.
