Resumen
[ES]El presente trabajo de investigación sistematiza la información obtenida acerca de la mediación familiar tradicional que aplica la comunidad gitana en su entorno, y realiza un análisis comparativo con la mediación familiar institucionalizada regulada en el derecho español.
Los resultados más destacables en cuanto a la comparativa realizada (contrato de mediación, proceso y figura del mediador) son las semejanzas que comparten un método con otro, principalmente respecto al papel del mediador familiar, con la peculiaridad de que para la comunidad gitana la persona mayor es la que ha asumido dicha función al representar una figura de autoridad familiar; siendo por otra parte, el respeto a la persona mayor un concepto universal. Asimismo, en ambos casos el servicio de mediación es voluntario, pero no en ambos gratuito.
En definitiva, el proceso de mediación familiar, como método alternativo de resolución de conflictos, no se encuentra aún del todo definitivo, pues las instituciones públicas del Estado, todavía buscan alternativas nuevas para la mejora de su aplicación.
[EN]The present "Research Work" brings together and systematizes the information obtained from an investigation about the traditional family mediation that the Gypsy community applies in its environment, in order to carry out a comparative analysis with the institutionalized family mediation regulated by Spanish law. The most noteworthy notes that results regarding the comparative study (the contract of mediation, the process, and the figure of the mediator) are the similarities that share one method with other, mainly regarding the role of the family mediator, with the peculiarity that, in the Gypsy community, the older person is which has assumed this function because this one represents a “familiar authority figure”; being, on the other hand, the respect for the older person a universal concept. As well, in both cases the mediation service is voluntary, but not in both free. Finally, family mediation, as Alternative Dispute Resolution Method (A.D.R), is not yet completely defined, as public state institutions are still looking for new alternatives for improving the implementation of the family mediation.
