Resumen
El objetivo de este trabajo es analizar, desde la perspectiva del Derecho
de la Propiedad Industrial, el Derecho de Patentes. Para abordar el
estudio de su contenido, partiremos de la Ley 24/2015, de 24 de julio, de
Patentes, con el objetivo de determinar sus principales características en
lo relativo a solicitud, concesión, nulidad y caducidad, y por último las
excepciones a la patentabilidad.
Los resultados de este análisis lo relacionaremos con aquellos actos
desleales que afectan directamente el Derecho de Patentes, centrándonos
en los actos de imitación y los actos de denigración. Para ello,
determinaremos las cláusulas que se establecen en la Ley de
Competencia Desleal. También, los mecanismos que ofrece el
ordenamiento jurídico español cuando se producen esta serie de actos.
Por último, haremos referencia a la jurisprudencia sobre estas normas en
casos de la actualidad para lograr una mejor comprensión de la
problemática tratada.
The objective of this work is to analyze, from the perspective of Industrial Property Law, Patent Law. To address the study of its content, we will start from Law 24/2015, on Patents, in order to determine its main characteristics in relation to application, concession, invalidity and expiration, and finally the exceptions to patentability. The results of this analysis will be related to those unfair acts that directly affect Patent Law, focusing on acts of imitation and acts of denigration. To do this, we will determine the clauses established in the Unfair Competition Law. Also, the mechanisms offered by the Spanish legal system when this series of acts occur. Finally, we will refer to the jurisprudence on these rules in current cases to achieve a better understanding of the problem addressed.
