Sistema de control del gobierno: el gobierno en funciones

Abstract

[ES]El presente trabajo tiene como objetivo el estudio del Gobierno en funciones en el ordenamiento español así como las limitaciones y problemática que suscita este tipo de Gobierno atendiendo a su regulación en el artículo 21 de la Ley 50/1997 del Gobierno. El Gobierno en funciones ostenta el poder ejecutivo del Estado desde el cese del Gobierno hasta la toma de posesión de un nuevo Gobierno. En España, el Gobierno cesante y el Gobierno en funciones son coincidentes, su finalidad es que éste órgano siga en funcionamiento hasta que el Parlamento invista a un nuevo Presidente, circunstancias excepcionales como las acontecidas durante la pasada Legislatura, han puesto en evidencia la necesidad de una regulación más exhaustiva sobre sus límites y funciones que se abordarán en este trabajo.

[EN]This work aims to the study of the Government functions in the Spanish legal system as well as the limitations and problems aroused by this type of Government according to its regulation in article 21 of the Law 50/1997 of the Government. The incumbent Government holds the Executive power of the State since the cessation of the Government until inauguration of a new Government. In Spain, the outgoing Government and the incumbent Government are coincident, its purpose is that this body follow operation until Parliament proclaim a new President, exceptional circumstances such as the periods during the last legislature, they have shown the need for more comprehensive regulation on their limits and functions that will be addressed in this work.
