[ES] La introducción del artículo 129 bis en el Código Penal, permite que se imponga la recogida y posterior registro de muestras de ADN, como consecuencia accesoria derivada del delito. Con su incorporación, las inscripciones de los perfiles genéticos en la base de datos policial de ADN, podrá realizarse tanto con la colaboración del condenado, como sin ella. Lo más destacable del contenido de esta consecuencia accesoria, es la posibilidad de utilizar medidas coactivas para su ejecución.
En este trabajo, he realizado un análisis de su contenido, además de estudiar los motivos que impulsaron su incorporación y sus fuentes normativas de referencia. Tras todo esto, he introducido algunas críticas, a la incorporación de esta nueva consecuencia accesoria jurídico-penal.
[EN] The insertion of the article 129 bis in the Penal Code allows to impose the collection of DNA samples and, then, its registration as an accessory consequence which comes from the crime. As a result of such incorporation, the inscriptions of genetic profiles in the DNA police database can be made not only with the convict’s cooperation, but also without it. The most remarkable of the content of this accessory consequence is the possibility of using coercive measures in order to be carried out. In this essay, I have done an analysis of its content apart from studying the reasons that drove its incorporation and its regulatory sources. Moreover, I have evaluated the incorporation of this new legal accessory consequence.
