LOS DELITOS COMETIDOS POR LOS FUNCIONARIOS PUBLICOS: PREVARICACION.

Abstract

[ES] El presente trabajo tiene por objeto de estudio analizar, interpretar e ilustrar el delito de prevaricación administrativa y judicial. En primer lugar encaminamos al lector en una secuencia lógica donde primero entenderá que se entiende por funcionario público desde el punto de vista penal, haciendo una breve introducción de los distintos delitos que nuestro código penal establece para las autoridades y funcionarios públicos. Finalmente analizaremos en profundidad el delito de prevaricación, recogido en los artículos 404 a 406 y 446 a 449 respectivamente, del Código Penal español, con el examen de cada uno de estos tipos delictivos

[EN] The present work has for object of study analyse, interpret and illustrate the crime administrative and judicial prevarication. we show to the reader a logical sequence first where he will understand that It mean servant public, from the penal point of view, doing a brief introduction of the different crimes that our penal code establishes for the authorities and government employees. Finally we will analyze in depth the crime of prevarication, in the articles 404 to 406 and 446 to 449 respectively, of the Penal Spanish Code, with the examination of each one of these criminal types.
