APROXIMACIÓN AL RÉGIMEN JURÍDICO DEL CONTRATO DE TRABAJO INTERNACIONAL.

Resumen
Cuando en los contratos individuales de trabajo se encuentra algún elemento extranjero, ya sea la empresa o empresario, el trabajador o el lugar donde se presta el servicio, estos se van a regular por las normas del Derecho Internacional Privado. Esto se debe a que los contratos de trabajo internacionales necesitan una respuesta adecuada a cada situación.
El Derecho Internacional Privado respecto al contrato de trabajo debe resolver tres situaciones: primero, debe determinar los Tribunales competentes para conocer del asunto; después, se va a determinar el derecho aplicable al litigio; y por último, las cuestiones en torno al reconocimiento y ejecución de sentencias extranjeras.
El contrato de trabajo destaca por sus especialidades respecto al resto de contratos, y esto se debe en gran parte a que hay una parte débil en la relación que debe ser protegida, el trabajador.
When in individual laboral contracts a foreign element is found, regardless the company or the bussinessman, the employee or the place where the service is delivered, those shall be ruled according to the norms of Private International Law. This is due to the fact that international laboral contracts need a suitable response to each situation. Private International Law in terms of laboral contracts must solve three situations: firstly, it must determine the competent Court to meet the bussiness; then, law applicable to the lawsuit; lastly, topics in terms of recognition and implementation of foreign sentences. Laboral contracts are known for their particularities in relation to other contracts, due mostly to the fact that there is a weak side in the relationship which must be protected, the employee.
