Protección jurisdiccional más allá de las fronteras nacionales.

Abstract

[ES] El trabajo tiene como objeto principal la protección jurisdiccional de los derechos fundamentales en España llevada a cabo en el ámbito internacional. Partiendo desde el inicio del artículo 10 de la Constitución, se mencionarán ciertos aspectos de gran relevancia en nuestro ordenamiento, tales como la Doctrina Parot y más en profundidad la Sentencia Del Río Prada; el derecho al olvido y las consecuencias tras el Caso Google VS España; la Orden Europea de Detención y Entrega, desde el Asunto Melloni hasta nuestros días con el Caso Puigdemont. Además, se hará referencia al principio de justicia universal, el cual tras numerosas modificaciones se ha visto privado y limitado en nuestra actualidad, dificultando enormemente la clausura de determinados procedimientos. [EN] The main purpose about the research is the jurisdictional protection of fundamental rights in Spain carried out in an international way. From the beginning of the article 10 CE, I’ll mention some aspects very importants in our legal system, such as Doctrina Parot and more in depth, Del Río Padra’s judgment; the Right to be Forgotten and the consequences about the Case Google VS Spain; the European Arrest Warrant, from the Melloni’s case to our days with the Puigdemont’s case.

Also, I’ll mention the universal jurisdiction which has had a lot of changes through the times and it’s limited in our days, actually, it’s so difficult close some process.
