Resumen
[ES] La idea primordial que se persigue con este trabajo es apreciar cómo ha afectado al Ordenamiento Español la trasposición de la Directiva 2011/83/UE del Parlamento Europeo y del Consejo sobre los Derechos de los Consumidores, en concreto los cambios que se han producido en el nuevo artículo 66 bis del Texto Refundido de la Ley General de Defensa de los Consumidores y Usuarios introducidos por la Ley 3/2014 respecto a la obligación del vendedor de entregar los bienes y las consecuencias de su incumplimiento, ampliando en la figura del plazo adicional y en la resolución del contrato. Asimismo, especificando que se entiende por bien de consumo y cuáles son los correspondientes contratos que se sujetan a esta norma, como son los contratos de compraventa o los contratos de obra. Teniendo como base fundamental la protección que se le concede en todo momento al consumidor o usuario frente al empresario.
[EN] The basic idea that is chased by this work is to estimate how the trasposición of the Board has concerned the Spanish Classification 2011/83/UE of the European Parliament and of the Advice on the Laws of the Consumers, in I make concrete the changes that have taken place in the new article 66 bis of the Remolten Text of the General Law of Defense of the Consumers and Users introduced by the Law 3/2014 with regard to the obligation of the seller to deliver the goods and the consequences of his breach, extending in the figure of the additional term and in the resolution of the contract. Likewise, specifying that understands itself for good of consumption and which are the corresponding contracts that subject themselves to this norm, since they are the contracts of sale or the contracts of work. Taking as a fundamental base the protection that is granted at all time to the consumer or user opposite to the businessman.
