La indignidad para suceder en el Derecho español.

Abstract

El Derecho sucesorio español garantiza que los parientes del causante reciban la parte de herencia que les corresponde y sanciona a aquellas personas que, dadas las conductas proferidas al causante, se consideran como indignas para sucederle. Estos dos aspectos son los que pretendo tratar en el presente trabajo, centrándome, principalmente, en la indignidad para suceder, entendida como la sanción que impone nuestro ordenamiento jurídico a aquellas personas que llevan a cabo una serie de conductas reprobables, las cuales, recogidas por ley, suponen la inhabilitación para suceder en cualquier herencia. Spanish inheritance law warrants the testator´s relatives´right to receive the part of inheritance that belongs to them and penalises those who, due to reprehensible behaviour towards the testator, are considered unworthy to inherit. In the current project, these are the two major aspects I´m going to deal with. I will focus, mainly, on the unwhorthiness to inherit and the penalty our legal system imposes on the person deemed unwhorthy, which involves judicial disqualification to inherit.
