Resumen
[ES] El artículo 18.2 de la Constitución Española recoge la inviolabilidad del domicilio como un derecho fundamental destinado a preservar la intimidad de las personas en su esfera personal y familiar. A través de este trabajo, se persigue plantear todo lo referente al delito de allanamiento de morada al particular previsto en el artículo 202 del Código Penal, con el correspondiente estudio del ilícito penal, igualmente se aborda el subtipo agravado cuando la conducta se lleva a cabo con violencia o intimidación, ubicado en el apartado segundo del mencionado artículo, así como el tipo cualificado, el cual implica la realización de la figura penal por una autoridad o funcionario público prevaliéndose de su condición pública, recogido en el artículo 204 del Código Penal.
[EN] Article 18.2 of the Spanish Constitution establishes the inviolability of the home as a fundamental right designed to preserve the privacy of persons in their personal and family sphere. Through this work, the aim is to raise all matters relating to the offence of breaking and entering, as provided for in article 202 of the Criminal Code, with the corresponding study of the criminal offence, the aggravated subtype is also addressed when the conduct is carried out with violence or intimidation, located in the second paragraph of the said article, as well as the qualified type, which implies the performance of the criminal offence by a public authority or official, taking advantage of its public status, as set out in article 204 of the Criminal Code.
