Igualdad de género y y velo islámico: algunas reflexiones

Abstract

[ES] Este trabajo tiene como finalidad abordar el tema del velo islámico desde la perspectiva del derecho a la igualdad. Actualmente nos encontramos con cientos de casos de niñas que no pueden acudir a sus centros escolares con el velo, o de restricciones de su uso en otros espacios públicos. A raíz de ésto surgen problemas, que deben ser resueltos aplicando la ley, incluso podríamos decir aquí el sentido común o el Derecho Natural. También se debe de tener en cuenta que la solución que se tome no atente contra los derechos fundamentales del individuo. La libertad religiosa de cada individuo es un derecho fundamental que la Constitución Española nos otorga, pero existen límites a ésta, siempre y cuando se ponga en peligro el orden público. Por lo tanto, a lo largo del presente trabajo iremos viendo cómo se han ido planteando éstos problemas y qué soluciones se han ofrecido.

[EN] This paper aims to address the issue of the Islamic veil from the perspective of the right to equality. Actually we find hundreds of cases of girls who can’t go to their schools with the veil, or restrictions on its use in other public spaces. Following this problems which must be solved by applying the law, we might even say here common sense or natural law arise. It should also take into account that the solution is taken not undermine the fundamental rights of the individual. The religious freedom of each individual is a fundamental right which the Spanish Constitution gives us, but there are limits to this, as long as endangering public order. Therefore, throughout this work we will see how they have been raising these issues and what solutions have been offered.
