EL CONTRATO DE HOSPEDAJE: ESTUDIO DE ALGUNAS PROBLEMÁTICAS JURÍDICAS, EN E ESPECIAL LA REPONSABILIDAD CIVIL POR DAÑOS

Abstract

[ES] El objetivo principal de este trabajo es indagar en el contrato de hospedaje como contrato entre un empresario hotelero y un consumidor, y en algunas de sus problemáticas jurídicas, dado que actualmente dicho sector sigue siendo un contrato turístico fundamental en nuestro sector, a pesar del auge de otras figuras jurídicas que ofrecen alojamiento. Para constatar el objetivo anterior, en un primer capítulo hacemos referencia a la definición y naturaleza jurídica del contrato de hospedaje, y a algunas problemáticas de la fase precontractual y contractual, tratando también la integración del contrato por la publicidad y la información precontractual. El segundo capítulo trata las incidencias posteriores al contrato, tales como la posibilidad de desistir del contrato, y las causas imputables e inimputables del incumplimiento. Por último, el capítulo tercero indagará en la problemática del incumplimiento del deber de depósito de los efectos del viajero, constatando brevemente la posición jurisprudencial al respecto.

[EN] The principal aim of this work is to investigate in the contract of accommodations as contract between a hotel businessman and a consumer, and in some of his problematic juridical ones, provided that nowadays the above mentioned sector continues being a tourist fundamental contract in our sector. To state the previous aim, in the first chapter we refer to the definition and juridical nature of the contract of accommodations, and to problematic some of the phase pre-contractual and contractual, treating also the integration of the contract for the advertising and the information pre-contractual. The second treats the incidents later to the contract, such as the possibility of desisting from the contract. Finally, the third chapter will investigate in the problematic of the breach of the duty of warehouse of the effects of the traveler, stating brief the jurisprudential position in the matter.
