LAS MEDIDAS CAUTELARES Y EL PROCESO LABORAL

Abstract

[ES] El presente trabajo tiene como objetivo el análisis exhaustivo de las medidas cautelares a lo largo de todo el proceso laboral, teniendo en cuenta todos los tipos de medidas para su posterior aplicación para asegurar la sentencia. También se va a analizar en qué momentos son aplicables y se puede llevar a cabo la práctica de las medidas cautelares, así como sobre qué parte recae la carga de exigirlas. Es necesario hablar tanto de las medidas acatables en cuestiones de accidentes laborales, los requisitos para la presentación de dichas medidas, como su alzamiento o incluso su sustitución por una fianza. Para terminar, también se analizará el proceso laboral, su configuración, principios y derechos que presenta, y la práctica de la prueba con la presentación de documentos para llegar a la aplicación de las medidas cautelares.

[ES] The objetive of this work is the exhaustive analysis of the precautionary measures throughout the labor process, taking in count the entire types of measures for their application to get a sucessful sentence. Also, it will be analysed in what moments are applicable and can be carried out the practice of precautionary measures, as well as on wich part falls the burden of demanding them. It is necesary to talk about both the aceptable measures in matters of working accidents, the requirements to present the measures, the lifting or replacement by a bond. Finally, the labor process will be analysed too, the configuration, principles and rights of it, and the practice of proof with the presentation of documents to arrive the application of precautionary measures.
