Abstract

[ES] El presente trabajo de fin de grado es concerniente a la materia de derecho de sucesiones. En él, concretamente, se tratarán aspectos relativos al negocio de la partición de la herencia, desarrollando el concepto de ésta y analizando y exponiendo su naturaleza jurídica, así como la controversia que rodea a la misma, junto a la enumeración de las personas que están legitimadas para solicitarla, así como a aquellas que, por carecer de algún requisito, no lo están. Analizando diferentes puntos de vista de la doctrina mostrando sus posiciones y argumentos en estos aspectos. Asimismo, se estudiarán los tipos de operaciones particionales existentes en nuestra legislación y como conclusión, se expondrá con detalle los efectos que esta operación trae consigo.[EN] The present end of degree work is relating to the subject of right of inheritance. On it, specifically, they will be deal with aspects related to the legal business of the partition of the inheritance, developing it concept and analyzing and explaining it legal nature, as in the controversy that surrounds it, next to the list of the people who are legitimized to request it, just like those that, due to lack of some requirement, are not. Analyzing different points of view from the doctrine searching over their poses and arguments in these aspects. Likewise, they will be studied the types of partitions operations existent in our legislation and as a conclusion, it will be explained in detail the effects that this kind of operation bring with it.
